1. ACCEPTANCE OF TERMS

By accessing, browsing, interacting with, placing a bid on, or purchasing digital advertising placement on Buy The Boat (accessible at buytheboat.lol), you agree to be bound by these Terms & Conditions ("Terms") and our Game Rules. If you do not agree with any part of these Terms or the Game Rules, you must immediately discontinue use of the platform and refrain from placing paid bids or purchasing advertising spots.

2. SERVICE DESCRIPTION & NOT A REAL ASSET

Buy The Boat is an interactive online digital advertising platform presented as a multiplayer browser game. Advertisers pay to bid for and display temporary digital promotional placements (such as logos, product names, URLs, and brand art) on a fictional, virtual 3D ocean vessel.

Buy The Boat does NOT sell, offer, or convey:
• Real-world vessel or ship ownership
• Real estate or physical property
• Securities, equity, tokens, or financial instruments
• Gambling entries, lottery tickets, or wagering opportunities
• Any promise of financial return, dividend, or cash appreciation

3. ADVERTISING PURCHASES

All purchases made on Buy The Boat are for digital advertising and promotional placement only. The exact price, placement type, bid amount, duration (if applicable), and gameplay health/points contributions are clearly displayed to the user prior to checkout. By confirming a purchase, you authorize the specific charge displayed.

4. BIDDING MODEL & OUTBIDDING

Certain placements on the vessel operate under a competitive bidding and replacement model. When a user submits a qualifying payment for a spot that exceeds or replaces the current advertiser, the new user's brand becomes the active displayed advertiser for that location.

Being outbid by a subsequent user does not reverse, refund, or cancel your prior purchase. Bids are not deposits or held escrow; they are payments for active advertising placement during the period your advertisement remains live on the vessel.

5. NO GAMBLING OR CASH REDEMPTION

Buy The Boat is strictly not a gambling, betting, or lottery service. Users do not pay for a random chance to win cash or financial prizes. All gameplay elements (including boat health percentages, Captain titles, rescue streak multipliers, leaderboard honors, and Rescue Points) are purely virtual cosmetic mechanics with zero cash value and cannot be converted, redeemed, or exchanged for currency.

6. PAYMENT PROCESSING VIA DODO PAYMENTS

All financial transactions are processed securely through our authorized third-party payment partner, Dodo Payments. Buy The Boat does not directly store, process, or transmit full credit card numbers or sensitive payment details. By completing a payment, you agree to comply with Dodo Payments' terms of service and privacy policies.

7. REFUND POLICY

DIGITAL ADVERTISING PURCHASES ARE GENERALLY FINAL AND NON-REFUNDABLE ONCE ACTIVATED.

Because digital advertising space is immediately provisioned, publicly rendered in 3D, and directly impacts live server game state, health calculations, and leaderboards upon payment confirmation, completed purchases are non-refundable.

Buy The Boat may, at its sole discretion, issue a refund or billing correction only in cases where:
• A user was mistakenly double-billed for the exact same transaction due to a gateway error;
• A technical failure directly caused by Buy The Boat permanently prevented the purchased ad from rendering; or
• A refund is explicitly required by applicable consumer protection laws.

8. OUTBID PAYMENTS NOT ELIGIBLE FOR REFUND

The replacement of an active advertisement by a subsequent higher bidder is an intended core mechanism of the platform. Being outbid does not constitute a service defect or payment failure and does not entitle the previous advertiser to a refund or chargeback.

9. PLATFORM AVAILABILITY & DOWNTIME

While we strive for high uptime, Buy The Boat does not guarantee uninterrupted or error-free availability. The service may occasionally be modified, updated, or temporarily unavailable due to routine server maintenance, emergency patches, hosting provider outages, distributed denial of service attacks, or other force majeure events.

10. ADVERTISER RESPONSIBILITY & WARRANTIES

As an advertiser, you represent and warrant that:
• You have the lawful right to promote the destination website and use all uploaded trademarks, logos, and creative assets;
• The submitted website and brand comply with all applicable local, national, and international laws;
• The destination URL is safe, does not harbor malware or deceptive scripts, and accurately represents the advertised entity.

11. LIMITED LICENSE TO DISPLAY CONTENT

You retain all intellectual property rights and ownership in your brand trademarks and uploaded logos. You grant Buy The Boat a worldwide, royalty-free, non-exclusive license to display, resize, crop, and render your submitted materials on the virtual vessel, in social share cards, in game recordings, and in marketing collateral promoting Buy The Boat.

12. PROHIBITED CONDUCT

Users may not engage in fraudulent bidding, chargeback abuse, automated scraping that degrades platform performance, security penetration testing without authorization, or the promotion of prohibited items (malware, illegal substances, hate content, non-consensual imagery, or counterfeit goods).

13. CONTENT MODERATION & TAKEDOWN

Buy The Boat reserves the right to immediately remove or modify any advertisement that violates our Game Rules or Terms, infringes copyright or trademark rights, or poses legal or payment processing liability. Removal due to terms violation is without refund.

14. PLATFORM INTELLECTUAL PROPERTY & ATTRIBUTIONS

All software, custom 3D models, shaders, user interfaces, branding, graphics, and gameplay mechanics of Buy The Boat are the intellectual property of the service operator and protected by intellectual property laws.

15. NO PERFORMANCE OR TRAFFIC GUARANTEES

We make no representations or warranties regarding the volume of impressions, click-through rates, customer acquisitions, conversions, search engine ranking improvements, or economic outcomes resulting from advertising placements.

16. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Buy The Boat, its creators, and operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or business interruption. In no event shall our total aggregate liability exceed the total amount paid by you for the specific advertising placement giving rise to the claim.

17. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Buy The Boat and its operators from and against any third-party claims, liabilities, damages, and expenses (including reasonable legal fees) arising from your advertisement, your submitted trademarks or logos, your destination website, or your violation of these Terms.

18. MODIFICATIONS TO SERVICE & GAMEPLAY

Buy The Boat continuously evolves. We reserve the right to modify game parameters, disaster frequency, health decay formulas, and slot pricing for future purchases. Changes will not retroactively revoke active paid placements without legitimate operational justification.

19. AMENDMENTS TO TERMS

We may revise these Terms from time to time. The date of the latest update will always be displayed at the top of this document. Continued use of the platform after revised Terms are posted signifies your agreement to the new terms.

20. TERMINATION & ACCESS RESTRICTION

We reserve the right to suspend or terminate access to the platform for any user who engages in malicious behavior, exploits software vulnerabilities, or violates these Terms.

21. GOVERNING LAW & DISPUTE RESOLUTION

These Terms and any disputes arising out of or related to the service shall be governed by and construed in accordance with the laws of the applicable jurisdiction of the service operator, without giving effect to any choice or conflict of law principles.
